Re: Notice on Immediate Self-Inspection and Comprehensive Cessation of Unauthorized Use of Olylife Marks and Olympic Symbols

Dear Distributors,

Thank you for your continued trust and support in Olylife.

We have recently become aware that certain distributors, without proper authorization and/or license from the relevant rights holders, have been using Olylife Marks and Olympic Symbols (as defined below) in their promotional materials, trademarks, trade names, domain names, websites, or have been making reference to them in marketing activities ("Relevant Conduct"). The Relevant Conduct may cause confusion among customers as to the source of goods or services, and may also infringe the legitimate rights and interests of the rights holders of the Olylife Marks and Olympic Symbols.

For the purpose of this Notice, "Olylife Marks" refer to:
(i) the word "Olylife", its abbreviations, its translations in various languages, and derivative fonts and derivative designs thereof; and
(ii) any mark incorporating any of the items set out in paragraph (i) above, whether or not registered as a trademark in any jurisdiction.

For the purpose of this Notice, "Olympic Symbols" refer to:
(i) The Olympic five rings symbol, Olympic flag, Olympic motto, Olympic emblem and Olympic anthem, rights in which are owned by the International Olympic Committee;
(ii) Proper names such as "Olympic", "Olympia", "Olympic Games", “Olympiad” and their abbreviations;
(iii) Names, emblems and symbols of any National Olympic Committees;
(iv) Names, emblems and symbols of current and past Olympic Games and their bid committees;
(v) Names and emblems of organizing committees of current and past Olympic Games;
(vi) Mascots, anthems, slogans, full names, abbreviations and other symbols of current and past Olympic Games; and
(vii) Other symbols related to the Olympic Games as specified in the Olympic Charter.

To ensure lawful and compliant operations and safeguard the long-term stability of our cooperation, all distributors are kindly requested to conduct self-inspections of their marketing activities, in particular the marketing materials, physical items, domain names, websites and the like used, and verify whether any Relevant Conduct exists. Please, within ten (10) days from the date of this Notice, take effective measures to cease the Relevant Conduct and eliminate the effects thereof.

Should the required rectifications not be completed within the prescribed time limit, Olylife reserves the right to issue lawyer’s demand letters, apply for injunctions, pursue liability for breach of contract or tort, initiate legal proceedings, or take other legal measures in accordance with the provisions of the contract and the applicable laws.

All legal liabilities arising from the Relevant Conduct shall be borne solely by the relevant distributors, and Olylife shall assume no responsibility therefor.

Olylife values its good relationship with all distributors and hereby issues this notice, hoping to jointly maintain a long-term, lawful and compliant cooperation with you.

This letter is without prejudice to any rights of Olylife to seek any legal remedies under applicable laws or contractual provisions.
